Pendaftaran merek itu mudah
Selama ini banyak anggapan dari pengusaha kecil dan menengah bahwa pendaftaran merek terlalu lama, biaya mahal, birokrasi dan tidak ada kepastian berapa lama sertifikat merek itu terbit.

Anggapan seperti itu wajar saja dan dibenarkan oleh Sudarmanto, Ketua Asosiasi Pengelola Kekayaan Intelektual (Aspeki). "Bagi UKM biaya pendaftaan merek masih menjadi kendala. Mereka juga mengeluhkan ketidakpastian waktu proses pendaftaran." katanya.

Keluhan pengusaha tersebut tidak perlu muncul ke permukaan bila saja mereka mendapat informasi yang tepat bagaimana sebenarnya proses, waktu, biaya untuk mendaftarkan sebuah merek dagang.

Permintaan pendaftaran merek dagang itu sebenarnya mudah asalkan pemohon menyiapkan segala persyaratan yang dibutuhkan. Yang membuat proses pendaftaran itu lama adalah bila pemohoan tidak melengkapi persyaratan, sehingga membutuhkan waktu dalam surat-menyurat antara Direktorat Merek dan pemohon.

Undang-Undang Merek (UU No. 15/2001) telah mengatur dengan rinci proses dan waktu pendaftaran sebuah merek dagang untuk memberikan kepastian bagi pemohon.

Bila pemohon sudah melengkapi semua persyaratan yang ditentukan dalam UU, maka dalam waktu 30 hari terhitung sejak tanggal permohonan, petugas melakukan pemeriksaan substantif.

Pemeriksaan substantif ini berlangsung selama sembilan bulan. Bila permohonan merek tersebut disetujui untuk didaftarkan, maka merek tersebut harus terlebih dahulu diumumkan dalam Berita Resmi Merek.

Pengumuman dalam Berita Resmi Merek berlangsung selama waktu tiga bulan untuk memberikan kesempatan kepada pihak lain untuk menyampaikan keberatan atas pendaftaran merek tersebut.

Bila tidak ada sanggahan dari pihak ketiga, maka permohonan merek tersebut disetujui untuk didaftarkan dan diterbitkan sertifikatnya. Praktis dibutuhkan waktu sekitar 12 bulan mulai dari pengajuan permohonan sampai terbitnya sertifikat.

Sedangkan biaya permohonan merek tersebut juga ditentukan oleh pemerintah melalui Peraturan Pemerintah No. 50 Tahun 2001.

Sesuai dengan PP itu, biaya resmi permintaan pendaftaran sebuah merek dagang atau jasa adalah Rp450.000, sedangkan biaya resmi untuk perpanjangan pendaftaran merek dagang/jasa sebesar Rp600.000. (lihat tabel)

"Biaya resminya memang sepeti itu. Tapi, kadang kala UKM di daerah bisa mengeluarkan biaya lebih besar dari ini apalagi bila mereka menggunakan jasa konsultan HaKI," kata Sudarmanto.

Dia menyarankan kepada UKM di daerah untuk memanfaatkan pendaftaran HaKI seperti hak cipta, paten, merek dan desain di daerah melalui Kantor Wilayah Departemen Hukum dan HAM. copie indag Jabar 20/11/08(Suwantin Oemar)
